Family Law Firm Helps Same-Sex Couples Divorce in Washington, DC

Douglas & Boykin’s Divorce attorneys guide you through the divorce process

Although same-sex marriage is currently legal in 37 states and the District of Columbia, divorce remains problematic for many same-sex couples. In many of the states that don’t recognize same-sex marriage, gay and lesbian couples can’t get a divorce. And if you were married in a state other than where you live, you likely would need to establish legal residency in the wedding state in order to get a divorce there.

Fortunately, the District of Columbia has taken steps to assist nonresident same-sex couples who were married in Washington, DC. Douglas & Boykin PLLC is prepared to guide same-sex couples through the divorce process in Washington, DC.

What’s the procedure for same-sex divorce in Washington, DC?

In 2012, the Council of the District of Columbia passed a law easing the residency requirements for same-sex divorces. Normally, to divorce in the District of Columbia, one of the spouses would have to be a DC resident for at least six months before filing for divorce. But under the District of Columbia’s law, divorce is available to spouses of the same gender, even if neither party is a resident of the District of Columbia at the time the divorce action is filed.

To qualify, there are two requirements: the marriage was performed in the District of Columbia, and neither spouse now resides in a jurisdiction that grants same-sex divorces. The law establishes a rebuttable presumption that any state that does not recognize same-sex marriage will not grant a same-sex divorce either.

The same-sex divorce lawyers at Douglas & Boykin will lead you through every step of the process, ensuring that your interests are protected.
