To qualify, there are two requirements: the marriage was performed in the District of Columbia, and neither spouse now resides in a jurisdiction that grants same-sex divorces. The law establishes a rebuttable presumption that any state that does not recognize same-sex marriage will not grant a same-sex divorce either.
